Terms and conditions for using DataPingo services.

Terms Summary

These Terms of Service govern your use of DataPingo's Atlassian Marketplace applications, including Bulk Page Cloner for Confluence and Bulk Comments for Jira. Our services are provided exclusively for business use. By installing or using our applications, you agree to these terms.

1. Acceptance of Terms

These Terms cover two different things, and it is worth being clear which is which.

  • This website. By accessing datapingo.com you agree to these Terms and to all applicable laws. If you do not agree, please do not use the site.
  • Our apps. Our applications are licensed and installed through the Atlassian Marketplace. Your use of an app is governed by the end user agreement identified on that app's Marketplace listing, together with the Atlassian Marketplace Terms of Use. Where a listing identifies no separate end user agreement, these Terms apply to your use of that app.

Where an app's end user agreement and these Terms say different things, the end user agreement governs for that app.

2. Description of Services

2.1 DataPingo Services

DataPingo provides productivity applications for Atlassian Confluence and Jira, available through the Atlassian Marketplace, including:

  • Bulk Page Cloner for Confluence: Instantly duplicate pages in bulk with preserved content, formatting, images, video, macros, labels, and attachments
  • Bulk Comments for Jira: Write one comment and post it to up to 25 Jira issues, write a different comment for each ticket, or copy an existing comment — images, videos, and files included — across many tickets

2.2 Platform and Hosting

Our applications are:

  • Atlassian Forge Platform: Built on and hosted by Atlassian's secure Forge platform
  • Cloud-Based: Delivered as Software-as-a-Service (SaaS) with no local installation required
  • Atlassian Marketplace: Distributed exclusively through the official Atlassian Marketplace
  • API Integration: Utilizes Atlassian's Confluence and Jira APIs for functionality

2.3 Software License

Your licence to use an app is granted by the end user agreement identified on that app's Atlassian Marketplace listing. Where a listing identifies none, DataPingo grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the application solely for your internal business purposes in accordance with these Terms.

Either way, the software is proprietary and all rights not expressly granted are reserved by DataPingo.

2.4 Business-to-Business Service

DataPingo's services are intended exclusively for business and organizational use. By using our services, you represent that you are acquiring them for business purposes and not as a consumer. Consumer protection laws may not apply to your use of our services.

3. Accessing the Services

3.1 Authentication via Atlassian

Access to our Services is provided through your Atlassian account and is subject to your organization's Atlassian access controls. DataPingo does not maintain a separate account or credential system for our Services — there is no DataPingo username, password, or account dashboard to create or manage.

3.2 Your Responsibility

You are responsible for maintaining the security of your Atlassian account and for all activity that occurs through it while using our Services, in accordance with Atlassian's applicable terms and your organization's access policies.

4. Acceptable Use Policy

4.1 Permitted Use

You may use DataPingo services only for lawful purposes and in accordance with these Terms. You agree not to use the services:

  • In any way that violates applicable laws or regulations
  • To transmit or procure the transmission of any unlawful, harmful, or objectionable content
  • To impersonate or attempt to impersonate DataPingo, DataPingo employees, or other users
  • To engage in any activity that interferes with or disrupts the services

4.2 Data Usage Limits

Our apps run within the rate limits and quotas of the Atlassian Forge platform and Atlassian's APIs. Excessive or abusive use that violates these Terms or Atlassian's platform limits may result in restricted functionality. Your applicable user tier is defined by your Atlassian Marketplace subscription.

5. Privacy and Data Protection

5.1 Data Collection

DataPingo collects and processes data necessary to provide our services. Our data collection and use practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

5.2 Customer Data

You retain ownership of all data you provide to DataPingo. We process your data solely to provide our services and in accordance with your instructions and applicable data protection laws.

6. Pricing and Billing

6.1 Pricing

Our apps are licensed through the Atlassian Marketplace, with pricing based on your Atlassian user tier. Current pricing, user tiers, and any free allowance for small teams are shown on each app's Atlassian Marketplace listing.

6.2 Billing, Renewals, and Refunds

All purchasing, billing, invoicing, taxes, renewals, and refunds are handled by Atlassian through the Atlassian Marketplace under Atlassian's terms — DataPingo does not collect payment or maintain billing accounts directly. Billing cycles, free trials, and refund eligibility are governed by the Atlassian Marketplace Terms of Use and the Atlassian Customer Agreement. If fees are not paid, Atlassian may suspend or revoke access to the app in accordance with those terms.

7. Intellectual Property Rights

7.1 DataPingo Property

DataPingo and its services, including all content, features, and functionality, are owned by DataPingo and are protected by copyright, trademark, and other intellectual property laws.

7.2 Customer Content

You retain ownership of all content you submit to DataPingo. By using our services, you grant us a limited license to access, process, and transmit your content solely to provide our services.

8. Service Availability and Modifications

8.1 Service Uptime

DataPingo does not take the apps offline for maintenance. Forge apps update in place through the Atlassian Marketplace, so there is no maintenance window and no scheduled downtime on our side — development and testing happen in separate environments before anything reaches production.

Availability itself is determined by Atlassian's platform rather than by DataPingo, and we do not guarantee uninterrupted service. See our Service Level Agreement for how this works in practice.

8.2 Service Modifications

DataPingo reserves the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice for significant changes that affect functionality.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. DataPingo does not warrant that the services will be uninterrupted, secure, or error-free.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DATAPINGO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, income, or business opportunities
  • Loss of data, content, or work product
  • Loss of contracts, reputation, or goodwill
  • Service interruptions, cyber attacks, or force majeure events
  • Any damages arising from use of or inability to use the services

DataPingo's total liability for all claims arising from or related to these Terms or the services shall not exceed the amount paid by you to DataPingo in the 12 months preceding the claim.

9.3 Essential Purpose

The limitations of liability set forth in this section shall apply even if any limited remedy fails of its essential purpose.

9.4 Indemnification

You agree to indemnify, defend, and hold harmless DataPingo, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use or misuse of the services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit, post, or transmit through the services.

10. Suspension and Termination

10.1 Ending Your Use

You may stop using our Services at any time by uninstalling the app from your Atlassian instance. Billing, cancellation, and any refunds for paid apps are handled by Atlassian through the Atlassian Marketplace in accordance with Atlassian's terms.

10.2 Suspension or Termination of Access

Because our Services are distributed and licensed through the Atlassian Marketplace, access to them is governed by your agreements with Atlassian. Atlassian may suspend or terminate access to the app — for example, for non-payment, violation of Atlassian's terms, or security or legal concerns — as described in the Atlassian Marketplace Terms of Use and the Atlassian Customer Agreement. DataPingo does not operate a separate account or licensing system and cannot independently suspend or revoke an individual customer's license. DataPingo may, however, discontinue, retire, or stop offering the app, or cease providing support, in accordance with these Terms and Atlassian's Marketplace policies.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Monmouth County, New Jersey, and you and DataPingo each consent to the personal jurisdiction and venue of those courts.

Three things this does not override:

  • Where mandatory law in your country of residence gives you the right to bring proceedings in your local courts, nothing here removes that right.
  • Because our apps are purchased through the Atlassian Marketplace, anything concerning purchasing, billing, or refunds is governed by Atlassian's own terms rather than by this section — see section 6.
  • Where an app's end user agreement specifies its own governing law or venue, that choice controls for use of that app — see section 1.

12. Changes to Terms

DataPingo reserves the right to modify these Terms at any time. We will post significant changes on this page and update the "Last Updated" date above. Continued use of our services after changes constitutes acceptance of the new Terms.
